I have been discussing punitive damages in car accidents and truck accidents this week . A main area of punitive damages claims can be presented in a case againist a drunk drivers .The National Highway Traffic and Safety Administration reports that alcohol related crashes accounted for 38 % of all highway fatalities .

Under current Tennessee Law , a party can recover punitive damages fron a drunk drivers' primary automobile insuance policy . It is important to look at a punitive damages claim in all cases involving a drunk driver.For example , one could recover the entire policy limits using a punitive damage claim . The purpose is to punish the drunk driver from driving intoxicated again .
