I just finished a deposition in a rear end car wreck case . The insurance company always uses the issue of pre-existing injuries as a defense to avoid paying the claim . One should be aware of the nature of the injury and basic medical knowledge . The doctor's report in these types of cases will refer to degenerative disk disease . One diagnosis is spinal stenosis . Spinal stenosis is the narrowing of the spinal canal . Many people over 50 have this stenosis without ever knowing it . The force of the collison will aggravate the condition which might require therapy or worse surgery . The key is reviewing all your medical records to prevent the insurance companies to assert this defense .
