Tractor-Trailer Accidents | InjuryBoard Nashville

One function of government is to insure and protect the safety of it's citizens . Trucking companies that ignore the safety rules should be watched , fined , or shut down .The public needs these trucks to transport the goods we need and the majority of the truck drivers are lawabiding folks . What should the government do ? Recently , the Federal Motor Carrier Safety Adminstration...

Today , the Tennessee Department of Safety wraps up intense safety inspections that have lasted the past 72 hours . The purpose was to reduce the number of unsafe trucks and drivers on the roadways . Since Tuesday , the Tennessee Highway Patrol has been conducting safety checks around the clock . The inspections also act to reduce the number of accidents involving commerical trucks...

The buzz word today is that many people apply the word frivolous lawsuit to most personal injury lawsuits . Frivolous is defined as having little value or importance . Recently , Injuryboard made me aware of a lawsuit filed in Wahington D.C. for 65 million dollars over a pair of pants that a dry cleaner damaged . The person that filed it was reported to be a magistrate . This...

Earlier this week , I wrote about the filing of the complaint . The filing of the complaint is the first step . After you file the case , the defendant must be served with a copy of the lawsuit . This is called service of process . There are several ways to do this and I will discuss this in another post . Once the defendant has beed served , they have 30 days in which to file their...

I am preparing for a depostion of a doctor in a commerical truck accident case today . It is vital to your case to be able to prove your medical expenses to prevail . As I was going thru the medical records , I was reminded that the medical proof is critical . A person may recover reasonable and necessary expenses for medical care , services , and supplies actually given in...

In my last post , I wrote that you do not always need a lawyer . Last weekend , it drove the point home that sometimes you do need an expert in certain cases . I tried to do some plumbing around the house , but I realized I was in over my head . The same holds true in handling your accident case . Cases in which there are serious injuries need an attorney . There are several...

In an accident case , one often has to pay back your health insurance benefits . Why ? Subrogation is a doctrine that is generally governed by eqitable principles rather than terms of the contract giving rise to the subrogation claim . The purpose of subrogation is to prevent a double recovery . Therefore , one has to pay back the benefits paid by the health insurance...

The role of govermnent should insure the safety of its citizens . Once again , the Bush Adminstration has come down the on the side of big business . Instead of protecting the public , the Federal Motor Carrier Safety Adminstration has established weak rules for electronic on-board recorders (EOBR). All commerical truck drivers have limits on the hours they can drive . The...

On Friday , I was speaking at a seminar to a group of lawyers sponsered by Barristers Educational Services . The topic I was speaking to them was on maintaining a sucessful trial practice . One of the areas was using demonstrative evidence . Demonstrative evidence covers many types of non-oral proof intended to demonstrate or explain to the trier of fact the events giving rise to the...

Truck drivers are limited to drive only 70 hours per week .They must take a rest break every 10 hours . Also , logbooks must be kept on their time driving . Getting the logbooks is one reason a truck accident case should be filed as soon as possible . One interesting fact that was on the radio today , new doctors are allowed to work 80 hours per week with no required rest break...
