Drug and Alcohol Testing in Truck Wreck Cases

Yesterday was my first post on the ten most important rules to know about a truck accident case . Today , it is drug and alcohol testing issues . C.F.R. Section 382.303 provides the rules on post accident drug and alcohol testing . The rule requires as soon as practicable following an accident involving a commerical vehicle the driver shall test for alcohol under certain circumstances . One , the accident involved the loss of human life . Second ,a trucker who received a citation for a moving violation and if a bodily injury occurs and one gets medical treatment or one or more vehicles are towed or moved from the crash site . Also , all truck drivers are subject to random drug and alcohol testing . The rules require retention of these records of substance abuse screenings as well as a host of other rules relating to alcohol and drug issues . This is another reason to get started fast on your truck accident case.
